"Injuries Sustained In Street Brawl Brought Death To Victim." James Levan Dies at Hospital - Henry Apple His Companion Under Arrest. Unconscious since Saturday December 23rd at the Allentown hospital, James Levan of 228 North ninth street, who sustained a fracture at the base of his skull during a street brawl wit Henry Appel, of Ninth and Jackson streets, who is now in jail died yesterday morning at 9:45 o'clock. The complication that had arisen as a result of the death were altogether unexpected. Levan and Apple who were known to be boon companions, became involved in a quarrel about a chew of tobacco at Seventh and Linden streets on December 9th. Both men, it is said were somewhat under the influence of liquor and according to eye witnesses, Levan called Apple some ugly names and the latter retaliated by giving him a half push and punch that caused him to fall backward and strike his head. He lay stunned and Apple picked him up and carried him to a nearby drug store, where he was found to be suffering from lacerations and concussion of the brain. He was taken to the hospital and there seemed to grow alright again and protested stoutly against the suggestion that he bring charges against Apple. Last Saturday afternoon, however, hi condition became worse and toward evening he sank into a state of coma, in which condition he remained until his death. All during the past week his life was despaired of, though once or twice he seemed to grow better and the doctors and nurses worked hard to save him. When it was seen that Levan would probably die, Apple was taken into custody and a warrant was sworn out before Alderman Schiffert charging him with assault and battery with intent to kill and he was committed to jail in default of $1000 bail to await to result of Levan's condition. Today Chief Bernhard, with change the charge to involuntary manslaughter. Apple is 65 years of age, was a carpenter by trade. He at one time served as patrolman and many sympathize with him for he has worried greatly since the affair. Levan was 52 years of age and resided with his sister, Mrs. Samuel Flickinger, of 228 North Ninth street, where the body was taken and funeral services will be held. The deceased was the son of the late Daniel and Anna Levan and was born in Weisenberg township. He was married to Mrs. Alice Stofflet, (nee Gernert), but they had been separated for 14 years. She and one daughter, Mrs. Jefferson Leibenguth, of Northampton; one step daughter, Mrs. Willoughby Arnold, of this city, and three sisters, Mrs. C.O.M. Bear, Mrs. Willoughby Lohrman and Mrs. Samuel Flickinger, of this city, and one half sister, Mrs. Phillip Wertman, of Lehighton, and a half brother, Willoughby Levan, of Rothrocksville, also survive. The funeral will be held on Wednesday afternoon at 2 o'clock from the home of his brother-inlaw, Samuel Flickinger, where he had made his home, at 228 North Ninth street. Services will be conducted at the hose by Rev. C.A. Greiss and interment will be made on Greenwood cemetery.
